TravelandMore.co.uk Agency Terms of Business

These are the terms on which we will make a booking for your travel or holiday requirements. When making your booking we will arrange for you to enter into a contract with the principal (tour operator/airline/cruise company or other supplier) named on your receipt. For charter flight, car hire, airport parking, resort transfer, chauffeur and attraction ticket bookings we act as agent for the principal but we act as your agent when making a booking with no frills airlines. As agent we accept no responsibility for the acts or omissions of the principal or for the services provided by the principal. The principal’s Terms & Conditions will apply to your booking and we advise you to read these carefully as they do contain important information about your booking. Please ask us for copies of these if you do not have them. 

BOOKING DETAILS:
Please check that all names, dates and timings are correct on receipt of all documents and advise us of any errors immediately. Any changes to these details will incur the charges stated below. Please ensure that the names given are the same as in the relevant passport.

NO FRILLS FLIGHTS:
The service we provide for you in respect of the purchase of standalone no frills flights is a different service than the service we provide for the sale of other airline tickets. These special terms apply to that service:

1. In the sale of standalone no frills flights we will search the relevant no frills database, and then, if you choose to buy, will purchase the flight seats on your behalf directly from the airline. We will receive an itinerary/confirmation email from the no frills airline which we will forward directly to you by email.

2. If you have any query in respect of the flight, please contact our Customer Services department who will approach the relevant airline on your behalf. We will, of course, use our best endeavours to ensure that all of your requests are complied with. However, if the no frills airline imposes any fee or charge on us to effect these changes, we reserve the right to pass on the charge to you.

3. You will be subject to the terms and conditions of the relevant no frills flights which will be deemed to be incorporated into this contract. They can be accessed from the relevant no frills website.

Our Terms of Business are governed by English Law and the jurisdiction of the English Courts. You may however, choose the law and jurisdiction of Scotland or Northern Ireland if you wish to do so.

PAYMENT: 
You will be required to pay a deposit or make full payment for your booking at the time of booking. Where you only pay a deposit you must pay the full balance by the balance due date notified to you. If full payment is not received by the balance due date, we will notify the principal who may cancel your booking and charge the cancellation fees set out in their Terms and Conditions.

CANCELLATION and AMENDMENT: 
Any cancellation or amendment request must be sent to us in writing and will not take effect until received by us. If you cancel or amend your booking the principal may charge the cancellation or amendment charge shown in their Terms and Conditions (which may be 100% of the cost of the travel arrangements) and you must pay us the cancellation or amendment charge stated below.

INSURANCE:
Many principals require you to take out travel insurance as a condition of booking with them. In any event, we strongly advise that you take out a policy of insurance in order to cover you and your party against the cost of cancellation by you; the cost of assistance (including repatriation) in the event of accident or illness; loss of baggage and money; and other expenses. If we have issued your policy please check it carefully to ensure that all the details are correct and that all relevant information has been provided by you (eg. pre-existing medical conditions). Failure to disclose relevant information will affect your insurance.

IF WE CHANGE YOUR ACCOMMODATION:
Every effort is made to maintain arrangements as confirmed to you, however, as they are planned many months in advance changes may occur for reasons beyond our control.

The accommodation providers reserve the right to change your accommodation to an alternative of the same or superior standard within the same resort.

Occasionally the accommodation providers may have to offer alternative accommodation of a lower standard or within a different resort to the original accommodation booked; in these circumstances compensation may be offered to you by the accommodation providers.

When the accommodation providers are unable to confirm a suitable alternative, we reserve the right to cancel the booking and an email notification will be sent to inform you of the details.

Please note once you have left to take up your accommodation, you have no right to cancel your reservation.

We reserve the right to cancel the contract between us if one or more of the order was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. If we do cancel your contract we will notify you by e-mail/letter and re-credit to your account any sum deducted by us from your credit/debit card as soon as possible. We will not be obliged to offer any additional compensation for disappointment suffered.

DELIVERY OF DOCUMENTS:
All documents (eg. invoices/tickets/Insurance policies) will be sent to you by First Class post. Once documents leave our offices we will not be responsible for their loss unless such loss is due to our negligence. If tickets or other documents need to be reissued all costs must be paid by you. You can ask for delivery by other means subject to the charges stated below.

PASSPORTS, VISAS AND HEALTH:
We can provide general information about the passport and visa requirements for your trip. Your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. Neither we nor the principal accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. Most countries now require passports to be valid for at least 6 months after your return date.  The UK Passport Agency can provide further information at www.ukpa.go.uk

Please take special note that for all air travel within the British Isles, airlines require photographic identification of a specific type. Please ask us for full details.

We can provide general information about any health formalities required for your trip but you should check with your own doctor for your specific circumstances.

FINAL TRAVEL ARRANGEMENTS:

Please ensure that all your travel, passport, visa and insurance documents are in order and that you arrive in plenty of time for checking in at the airport. It may be necessary to reconfirm your flight with the airline prior to departure. Please ask us for details at least 72 hours before your outbound flight. You should take a note of any reference number or contact name when reconfirming. If you fail to reconfirm you may be refused permission to board the aircraft and you are unlikely to receive any refund.

COMPLAINTS:
Any dissatisfaction regarding your travel or holiday arrangements must be reported to the principal or their local supplier or agent immediately. If you fail to follow this procedure there will be less opportunity to investigate and rectify your complaint. The amount of compensation you may be entitled to may be reduced or you may not receive any at all depending upon the circumstances. If the matter cannot be resolved and it involves us or another ABTA member then it can be referred to the arbitration scheme arranged by ABTA www.abta.com

In certain circumstances we apply a service charge for the services we provide:

You agree to defend and indemnify TravelandMore.co.uk, its affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:
(a) Your breach of these Web Site Terms, Conditions and Notices or the documents referenced herein;
(b) Your violation of any law or the rights of a third party; or
(c) Your use of this Web site.

Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found on the FCO's website currently located at http://www.fco.gov.uk/travel; or BBC Ceefax. Online medical advice for travellers can be found at the Department of Health's website currently located at http://www.doh.gov.uk. Otherwise, for medical advice regarding your journey, please contact your GP or the Department of Health

If an airline cancels or delays a flight, is unable to provide previously confirmed space, fails to stop at your stop-over or destination point, or causes you to miss a connecting flight on which you holds a reservation, you are entitled to certain remedies from the airline in accordance with EC Council Regulation 261/04 and you should raise this with the airline concerned

UNREASONABLE BEHAVIOUR:
If in the reasonable opinion of a person in authority including a pilot or captain you are not fit to travel, he or she may refuse to let you board the aircraft or train or ship. Normally this happens if such a person thinks you are likely to disturb or harm other passengers. In this case your contract with us will end immediately and we will no longer be responsible for you. In addition if your behaviour is such that an hotelier’s reasonable opinion leads him or her to the view that they are unable to accommodate you, you may be asked to leave the hotel. In this instance no refund for lost night’s accommodation will be made and the cost of any other accommodation or travel expenses will be absolutely your responsibility we will also hold members of your party jointly and individually liable for any damage to the property, together with legal costs incurred in pursuing the claim. We can not be held responsible for the behaviour or actions of other individuals or guests who have no connection with your holiday arrangements or ourselves.
